Online Registration Agreement, Terms & Conditions

1. PLATFORM OVERVIEW

Host Your Tour is a digital tourism marketplace that allows registered Hosts to list and promote tourism services such as tours, and accommodation, related activities in Bhutan.

Host Your Tour does not own, manage, or operate any listed services.

2. ELIGIBILITY & LEGAL COMPLIANCE (BHUTAN)

By registering, you confirm that:

• You are at least 18 years old.
• You hold valid licenses, permits, and approvals required under:
• Department of Tourism (DoT) and Ministry of Trade and Industry in Bhutan
• Relevant local authorities from Bhutan
• You comply with all Bhutan tourism laws, safety regulations, labor laws, tax obligations, and environmental policies.
• Host Your Tour may request documents for verification at any time.

3. HOST RESPONSIBILITIES

You agree to:

• Provide accurate service details, pricing, and availability
• Deliver services safely, professionally, and ethically
• Honor confirmed bookings
• Follow Bhutan's sustainable & responsible tourism principles
• Communicate clearly with travelers
• Handle customer complaints fairly

You are fully responsible for your staff, guides, vehicles, insurance, and service execution.

4. COMMISSION & PAYMENTS

• Host Your Tour applies a platform commission of 8% on each confirmed booking.
• This 8% commission is added on top of the total tour price uploaded by the Host and is charged to the end client at the time of booking.
• The commission is NOT deducted from the price listed or earnings uploaded by the Host on the Platform.
• The Host will receive the full listed tour price as uploaded on the Platform, subject to successful service delivery and payout terms.
• All prices uploaded by the Host must be accurate and must clearly exclude the Platform commission, which will be displayed separately to the end client.
• Hosts are solely responsible for declaring and paying all applicable Bhutan taxes, duties, and government charges on their earnings.
• Platform commission fees are non-refundable once a booking is confirmed, except where required by law.

5. BOOKINGS, CANCELLATIONS & REFUNDS

• Each Host must clearly state their cancellation and refund policy.
• Refunds shall be processed according to The Host's stated policy - Host Your Tour's Refund Policy
• Host Your Tour is not liable for refund disputes but may assist in resolution.

6. PRIVACY & DATA PROTECTION

• Personal and business data is collected and processed as per our Privacy Policy.
• Hosts must not misuse traveler data or share it without consent.
• Any data breach or misuse may result in account suspension or legal action.

7. CONTENT & MARKETING RIGHTS

• You own your content but grant Host Your Tour the right to:
  • Display your listings
  • Promote services online and offline
  • Use content for marketing purposes
• Content must be truthful and must not infringe third-party rights.

8. PROHIBITED ACTIVITIES

You must NOT:

• Provide false or misleading information
• Operate without required Bhutan Tourism approvals
• Bypass the platform to avoid commission
• Engage in unethical, unsafe, or illegal tourism activities
• Post offensive or discriminatory content

9. ACCOUNT SUSPENSION & TERMINATION

Host Your Tour may suspend or terminate accounts if:

• Laws or tourism regulations are violated
• Complaints or safety concerns arise
• Fraudulent activity is detected

Termination does not remove your responsibility to existing travelers.

10. DISCLAIMER

• Host Your Tour provides the platform on an "as-is" and "as-available" basis. We do not control the tours, services, or actions of Hosts or Customers.
• We do not guarantee that registering on the Platform will result in:
  • Any bookings from travelers
  • Any specific income or revenue
  • Business growth, popularity, or success
• The Platform cannot guarantee the accuracy, completeness, or reliability of any content uploaded by Hosts or any feedback/reviews from Customers.
• Hosts are responsible for the quality, safety, legality, and delivery of their services.
• Host Your Tour is not responsible for any losses, damages, or costs incurred by Hosts or Customers due to unfulfilled bookings, cancellations, service complaints, or traveler dissatisfaction.
• The Platform provides tools, visibility, and promotion, but the success of your business depends on your service quality, customer interaction, pricing, and compliance with laws and tourism regulations.

11. LIMITATION OF LIABILITY

Host Your Tour is not responsible for:

• Accidents, injuries, or losses during tours
• Service quality or customer disputes
• Financial or reputational losses

Maximum liability is limited to fees paid to the Platform in the last 12 months.

12. INDEMNITY

You agree to indemnify Host Your Tour against claims, damages, penalties, or legal costs arising from:

• Breach of this Agreement
• Violation of Bhutan laws
• Claims by travelers or authorities

13. GOVERNING LAW

This Agreement is governed by the laws of the Kingdom of Bhutan.

All disputes fall under the jurisdiction of Bhutanese courts.

14. CHANGES TO TERMS

Host Your Tour may update these Terms from time to time. Continued use means acceptance of updates.

15. FINAL ACCEPTANCE

By clicking "I Agree", you confirm that:

• You have read and understood these Terms
• You agree to the Privacy Policy & Refund Policy
• You are legally authorized to operate tourism services in Bhutan
